| A traumatic brain injury, also known
as an acquired brain injury, is often undiagnosed because the symptoms
can be fairly subtle. They may range from mild to moderate to severe
depending on the extent of the injury. Symptoms of traumatic brain
injury may include:
•short term memory loss
•long term memory loss
•forgetfulness
•irritability
•personality changes
•low tolerance
•high frustration
•hostility
•aggressiveness
•social isolation
•lack of impluse control
The effects of acquired brain injury, though often
subtle, can have devastating effects on an individual's life, as
well as on those of their family and friends. Making juries appreciate
and understand every way in which your injury effects your life
so that you can receive full and complete compensation is the firm's
overriding goal.
A person can suffer a traumatic brain injury which
will effect the rest of their life even without loss of consciousness.
A traumatic brain injury can vary in severity from profound to mild
and yet, even in its mildest form, a traumatic brain injury can
have a devastating effect upon a person's life, family, friends
and career.
Has your injury resulted in traumatic brain injury?
Oftentimes, if there has been loss of consciousness,
with or without prolonged coma, the fact of a traumatic brain injury
is obvious. However, there are a wide range of traumatic brain injuries
which can have a permanent effect on your life and cause you or
a loved one loss of income, loss of family relationships and a profound
loss of enjoyment and quality of life and such a traumatic brain
injury can occur even without a loss of consciousness or "blackout".
If you or a loved one has suffered a blow or injury
to the head as a result of a motor vehicle collision, fall, being
struck by an object or from whatsoever source and, as a result,
have had a change in consciousness (feel woozy, confused, dizzy,
disoriented) and/or suffered immediate onset of nausea and/or vomiting,
you may have suffered a traumatic brain injury.
In one case which Mark and Patricia McCloskey tried
to verdict in the City of St. Louis, a woman suffered a slip and
fall in a hotel bathroom due to a defective bathtub spout. Although
she never lost consciousness after striking her head, she suffered
a traumatic brain injury resulting in a significant change in her
personality, causing her to lose her employment, her friends, her
family and the quality of her life. Although this individual never
lost consciousness and had no external or obvious sign of injury,
a jury in the City of St. Louis awarded her Four Million Dollars
($4,000,000.00) in compensation for her injury.
The key to obtaining just compensation for her, as
it is in all cases involving brain injury, was careful preparation
including the diagnosis of and quantification of the traumatic brain
injury through the use of neuropsychological testing, appropriate
life care planning and the use of sophisticated brain imaging technology,
including CT scanning, MRI scanning, PET and/or SPECT scanning and
the retention of knowledgeable and qualified expert witnesses. If
you believe that you or a loved one has suffered a traumatic brain
injury as a result of negligence, malpractice or mistake on the
part of another, McCloskey, P.C. has the experience and expertise
to ensure that the full extent of such injury is uncovered, explained
and fully compensated.
